What is a PEO?

A Professional Employer Organization (PEO) enters into a co-employment arrangement with your business. PEOs are ideal for businesses that already have a legal entity in India but want to offload the complexity of multi-state compliance. What is an EOR?

An Employer of Record (EOR) goes a step further. The EOR becomes the legal employer of your workers on paper, while you maintain the functional management relationship. This means you don't need a registered entity in India at all — the EOR handles everything from employment contracts to statutory filings.

The Complete Guide to Labour Law Compliance in India

India's labour law landscape is one of the most complex in the world. With both central and state-level regulations, businesses must navigate a web of requirements that vary depending on where their employees are located, the size of the workforce, and the industry they operate in.

Provident Fund (PF)

Under the Employees' Provident Fund and Miscellaneous Provisions Act, 1952, establishments with 20 or more employees must register with the EPFO. Both employer and employee contribute 12% of basic wages. Late deposits attract penalties, and non-compliance can result in prosecution. PF registration, monthly contributions, and annual returns require meticulous record-keeping.

Employee State Insurance (ESI)

ESI provides medical, sickness, maternity, and disability benefits to employees earning up to ₹21,000 per month. Employers contribute 3.25% and employees 0.75% of gross wages. The scheme is mandatory for establishments with 10 or more employees in most states. Registration must happen within 15 days of the Act becoming applicable.

Professional Tax

Professional tax is a state-level tax with varying rules across states. Karnataka, Maharashtra, West Bengal, and several other states levy it. The maximum annual liability is ₹2,500, but the slabs, due dates, and filing processes differ by state. Employers are responsible for deducting and remitting this tax for their employees.

Tax Deducted at Source (TDS)

Employers must deduct income tax at source from employee salaries based on applicable slab rates. TDS must be deposited with the government by the 7th of the following month. Quarterly TDS returns (Form 24Q) must be filed, and annual Form 16 certificates issued to employees. Errors or delays attract interest and penalties.
